The O&P Alliance has been busy the last few months with various legislative initiatives.
ABC and the Alliance submitted extensive comments to CMS on the draft rules to implement BIPA Section 427. The rules would establish who is qualified to provide custom O&P services to Medicare beneficiaries. There has been no announcement from CMS related to a release of a final rule. CMS has three years to release a final rule. If no final rule is released in that time, a new proposed rule would have to be published which would start the process all over.
The Alliance also worked on various other topics this year, including: responding to an automated audit announced by Performant (new national DMEPOS RAC auditor) related to HCPCS code L5845 (stance flexion code), meeting with CMS officials to get an update on the Interagency Workgroup created from the draft LCD issue and analyzing three O&P related Federal bills; 1) Medicare O&P Improvement Act, 2) Injured and Amputee Veterans Bill of Rights and 3) Wounded Warrior Workforce Enhancement Act.
